Terms of Service
1. Acceptance of Terms
Access and use of the IMOKAYA platform (website, mobile apps) are subject to these Terms of Service and our Privacy Policy. By registering or browsing the site, you acknowledge that you have read, understood and accepted all of these documents.
2. Roles and Registration
IMOKAYA allows several types of users to register: tenants (housing seekers), private owners, real estate agencies, hotel promoters. Each user agrees to provide accurate and up-to-date information when registering. Accounts are personal and non-transferable.
3. Property Listings
Owners, agencies and hotels may publish property listings (apartments, houses, hotel rooms, etc.). They are solely responsible for the content of the listings. IMOKAYA reserves the right to verify and reject any listing that does not comply with its policy or applicable law.
4. Bookings and Contracts
Hotel room bookings are made through the platform and are payable online. For standard rentals, a lease agreement is generated between the owner and the tenant, with electronic signature. Both parties agree to respect the terms of the contract.
5. Payments and Commissions
Rents are paid via IMOKAYA. A 5% commission is charged on each rent to finance the service (payment security, legal support). Hotel bookings are not subject to this commission, but transaction fees may apply.
6. Withdrawals
Owners and agencies may request withdrawal of their available funds via Mobile Money, bank transfer or Pi-Spi. Requests are processed within 48 to 72 business hours. IMOKAYA reserves the right to verify the beneficiary's identity.
7. Liability
IMOKAYA acts as a matching platform. It is not responsible for disputes between users (damages, non-payment, inaccuracy of listings). We strive to verify listings but do not guarantee absolute accuracy. In the event of a dispute, users agree to attempt an amicable resolution before any legal action.
8. Modification of Terms
IMOKAYA may modify these terms at any time. Modifications take effect upon publication. Users will be informed by email or by a notification on the platform.
9. Applicable Law
These terms are governed by Beninese law. Any dispute shall be brought before the competent courts of Cotonou.
Privacy Policy
1. Data Collected
We collect information you provide directly: name, email, phone number, address, ID document, professional documents (license, company name). We also collect browsing data (IP address, device type, pages visited) via cookies.
2. Use of Data
Your data is used to: create and manage your account, publish listings, facilitate bookings and contracts, process payments and withdrawals, inform you of updates, improve our services and prevent fraud.
3. Data Sharing
We share your data only in the following cases: with other users involved in a transaction (tenant/owner, customer/hotel), with our payment and hosting providers, if required by law or to protect our rights. We never sell your personal data.
4. Data Retention
Your data is kept for as long as your account is active. After account deletion, data necessary to evidence transactions (contracts, payments) is kept for 5 years in accordance with the law.
5. Your Rights
Under applicable regulations, you have the right to access, rectify, erase and port your data. You may also object to processing. To exercise these rights, contact us at privacy@imokaya.com.
6. Cookies
We use essential cookies for site operation (authentication, cart) and analytical cookies (Google Analytics) to improve experience. You can set your browser to refuse cookies, but some features may be impaired.
7. Security
We implement technical and organizational measures to protect your data against unauthorized access, loss or destruction. ID documents are stored encrypted.
8. Changes to this Policy
We may update this policy. Any changes will be posted on this page with a revision date. Users will be informed by email in case of material change.
